Fooddepaux is an online retailer specialising in snacks, drinks, breakfast and pantry items (including cereals and syrups), chocolates, sweets, and confectionery (together, "Products") for delivery within the United Arab Emirates (UAE).

2. Acceptance of Terms
By accessing or using the Site, you confirm that you have read, understood, and agree to be bound by these Terms. We may refuse service, cancel orders, or terminate accounts where permitted by law.
We reserve the right to update these Terms at any time. The updated version will be posted on the Site with a revised "Last updated" date. Your continued use of the Site after changes constitutes acceptance of the revised Terms.
3. Eligibility
To use the Site and place orders, you must:
- Be at least 18 years old (or the age of legal majority in your jurisdiction).
- Have the legal capacity to enter into a binding agreement.
- Provide accurate and truthful information.
We currently deliver within the UAE only. Orders with delivery addresses outside the UAE will not be processed.
4. User Accounts
You can browse the Site without creating an account. If you create an account, you agree to:
- Provide accurate, current, and complete information during registration.
- Keep your login credentials confidential and not share them with anyone.
- Notify us immediately if you suspect unauthorised access to your account.
- Accept responsibility for all activity that occurs under your account.
We may suspend or terminate accounts that violate these Terms, misuse the Site, engage in suspected fraud, or are inactive for an extended period. Upon termination, any outstanding store credit may be forfeited at our discretion.
One Account Per Person
Each individual may maintain only one account. Creating multiple accounts to exploit promotions, circumvent restrictions (such as COD limits), or manipulate our policies is prohibited and may result in all associated accounts being terminated.
5. Product Information, Allergens & Shelf Life
Product Descriptions
We work to display accurate product information, including descriptions, images, ingredients, nutritional information, and allergens. However, because we sell imported products:
- Manufacturers may change packaging, ingredients, formulations, or labelling without prior notice to us.
- Product images on the Site are for illustration purposes. The actual product received may differ slightly in packaging, design, or labelling from what is shown.
- Products may differ from locally available versions of the same brand.
- Weight, size, and quantity listed are approximate and may vary slightly.
Allergens & Dietary Information
Always check the physical product label before consuming, especially if you have allergies, intolerances, or dietary restrictions.
While we display allergen and ingredient information in good faith based on manufacturer data, we cannot guarantee that this information is always up to date. We are not liable for allergic reactions or adverse effects where allergen information was available on the physical packaging.
Expiry Dates & Shelf Life
We aim to ship Products with reasonable remaining shelf life. Imported products may have shorter remaining shelf life compared to locally produced equivalents. Expiry date formats may vary by country of origin.
If you receive an item that is expired at the time of delivery, report it within 24 hours as per our Returns, Refunds & Exchanges Policy.
6. Pricing, Currency & Taxes
Currency: All prices are displayed in United Arab Emirates Dirhams (AED).
Prices: Product prices shown on the Site are inclusive of applicable taxes (including VAT and excise tax where applicable). Delivery fees are calculated separately and displayed at checkout.
Pricing errors: In the event of a pricing error, we may contact you to confirm the correct price or cancel the order and issue a full refund. We are not obligated to fulfil orders placed at an incorrect price.
Price changes: We reserve the right to change product prices at any time without prior notice. The price applicable to your order is the price displayed at the time you place the order.
We do not offer price matching against other retailers, marketplace sellers, or pricing on other platforms.
7. Payment

Available payment methods may vary depending on your device, location, order value, and account standing. All available options will be shown at checkout.
Payment Processing & Security
All online payments are processed securely through third-party payment providers (such as Shopify Payments, Stripe, PayPal, Apple Pay, and Shop Pay). Fooddepaux does not store full card numbers, security codes (CVV), or complete payment credentials on its servers.
Billing & Account Information
You agree to provide current, complete, and accurate purchase and account information for all orders. This includes your full name, billing address, delivery address, email address, phone number, and payment details.
You agree to promptly update your account and payment information so that we can process your transactions, complete delivery, and contact you where necessary.
Orders may be delayed, declined, or cancelled if the information provided is inaccurate, incomplete, or cannot be verified.
Cash on Delivery (COD)
- You agree to be available at the delivery address to complete payment upon delivery.
- Please ensure the exact cash amount is available. Our drivers do not carry change.
- A COD handling fee of AED 10 per transaction applies.
- Failure or refusal to complete payment at delivery may result in the order being returned, delivery charges being applied, and COD being restricted or removed for future orders.
- Repeated COD refusals (two or more) will result in COD being permanently disabled on your account.
Card on Delivery is temporarily unavailable. When this service is restored, it will appear as an option at checkout. If it is not showing at checkout, it is not currently available.
Fraud Prevention
We may carry out verification checks on any order. Orders may be held, cancelled, or refunded if fraud, unauthorised activity, or suspicious behaviour is detected. This includes, but is not limited to:
- Use of stolen or unauthorised payment methods.
- Mismatched billing and delivery information.
- Multiple accounts associated with the same payment method or address.
- Unusual ordering patterns or volumes.
8. Orders, Confirmation, Cancellations & Changes
Order Placement
When you place an order, you are making an offer to purchase. An order confirmation email acknowledges receipt of your order but does not constitute acceptance or guarantee of fulfilment. A binding contract is formed only when we dispatch your order.
We reserve the right to decline or cancel any order for any reason, including but not limited to stock unavailability, pricing errors, suspected fraud, or delivery limitations.
Order Changes
Changes to an order (items, quantities, delivery address, delivery time) can only be made before the order is dispatched. Contact us as soon as possible. Once dispatched, changes are not possible.
Address Changes After Ordering
Before dispatch: Contact us immediately and we will update the address at no extra charge where operationally possible.
After dispatch: Address changes may not be possible. If the order is delivered to the original address you provided, no refund or free re-delivery will be issued. See our Shipping & Delivery Policy for full details.
Order Cancellation by You
- Before dispatch: You may cancel for a full refund to your original payment method.
- After dispatch: Cancellation is not possible. If you refuse delivery, delivery charges and return logistics fees may apply. See our Returns, Refunds & Exchanges Policy.
Order Cancellation by Us
We may cancel an order at any stage if:
- The product is out of stock or discontinued.
- A pricing or product listing error occurred.
- We are unable to verify your payment or identity.
- The delivery address is outside our service area or unreachable.
- We suspect fraud or Terms violations.
If we cancel an order, you will receive a full refund to your original payment method.

How we handle deliveries and returns
9. Delivery
Delivery is governed by our separate Shipping & Delivery Policy, which covers delivery options, timelines, fees, delivery windows, Ramadan hours, holiday surcharges, failed deliveries, and proof of delivery. By placing an order, you agree to the terms of that policy.
Available delivery options may change from time to time due to operational requirements, religious observances, public holidays, or regional disruptions. The options displayed at checkout reflect what is currently available. If a delivery option does not appear at checkout, it is not available at this time.
10. Returns, Refunds & Exchanges
Returns, refunds, and exchanges are governed by our separate Returns, Refunds & Exchanges Policy. By placing an order, you agree to the terms of that policy.
11. Gift Wrapping
Gift wrapping may be available on selected orders. Where available, select gift wrapping at checkout or add a note to your order. Gift wrapping may be unavailable for certain items or order sizes, and may carry an additional charge (shown at checkout where applicable).
12. Promotions & Discount Codes
Promotions, discount codes, and special offers:
- Are subject to any terms displayed at the time of the offer.
- May be limited to one per customer, per order, or per account.
- Cannot be combined with other offers unless expressly stated.
- Cannot be exchanged for cash or applied retroactively.
- May be withdrawn, modified, or refused at any time without prior notice.
- May be revoked where misuse, fraud, or abuse is suspected (including use of multiple accounts).
We reserve the right to void transactions, revoke discounts, and charge the full price where promotional codes were used in violation of their terms.
13. Store Credit
- Store credit is issued at our discretion and may be used on future purchases.
- Store credit is non-transferable and not redeemable for cash.
- Store credit may expire. Any expiry date will be communicated at the time of issue.
- Store credit may be forfeited if your account is terminated for violation of these Terms.
14. Reviews & User-Generated Content
If you submit reviews, comments, photos, ratings, or other content ("User Content"), you confirm that:
- You have the right to post the content.
- The content is truthful and based on genuine experience.
- The content does not infringe any third-party rights.
You grant Fooddepaux a worldwide, royalty-free, perpetual licence to use, reproduce, display, adapt, and distribute User Content for our business, marketing, and promotional purposes.
We may remove User Content that is unlawful, misleading, defamatory, obscene, harmful, or that violates these Terms, without prior notice.
15. Acceptable Use
What you agree to and not to
You agree not to:
- Use the Site for any unlawful, fraudulent, or harmful purpose.
- Misuse the Site, attempt unauthorised access, or interfere with its security or functionality.
- Scrape, copy, or reproduce Site content, data, product information, or pricing without our written permission.
- Use bots, scrapers, or automated tools to access the Site.
- Create multiple accounts to exploit promotions, circumvent restrictions, or manipulate reviews.
- Submit false or fraudulent orders, claims, or chargebacks.
- Impersonate another person or entity.
- Harass, abuse, or threaten our staff, customer service representatives, or delivery partners.
- Attempt to resell Products purchased from Fooddepaux without our written consent.
Violation of these terms may result in account suspension or termination, cancellation of orders, forfeiture of store credit, and/or legal action.
16. Intellectual Property
All Site content, including text, graphics, logos, mascots, brand names, product photography, designs, software, and the overall look and feel of the Site, is owned by or licensed to Fooddepaux and protected by applicable copyright, trademark, and intellectual property laws.
You may not use, reproduce, modify, distribute, or display our branding, logos, or Site content without our prior written permission.
Third-party trademarks and brand names displayed on the Site belong to their respective owners and are used for product identification purposes only.
17. Privacy & Data Protection
Your use of the Site and any personal data you provide is governed by our Privacy Policy, which is incorporated into these Terms by reference.
By using the Site and placing orders, you consent to the collection, use, and processing of your personal data as described in the Privacy Policy, in accordance with applicable UAE data protection laws.
18. Third-Party Services & Links
The Site may contain links to third-party websites, services, or content. We are not responsible for the content, accuracy, privacy practices, or availability of third-party services.
Our delivery, payment processing, and other operational services are provided by third-party partners. While we select our partners with care, we are not liable for their independent actions or omissions beyond the scope of our agreement with them.
19. Disclaimers
The Site and Products are provided on an "as is" and "as available" basis, to the maximum extent permitted by law.
While we make reasonable efforts to ensure accuracy, we do not warrant that:
- The Site will be uninterrupted, error-free, or secure.
- Product descriptions, images, or nutritional information will always be completely accurate.
- All Products will be available at all times.
Nothing in these Terms excludes or limits any rights or remedies that cannot be lawfully excluded or limited under applicable UAE law, including the UAE Consumer Protection Law.
20. Limitation of Liability
To the maximum extent permitted by applicable law:
- Fooddepaux will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Site or Products.
- Where liability cannot be excluded under applicable law, we do not exclude it.
- Where liability can be limited, our total aggregate liability for any claim or series of connected claims is limited to the amount actually paid by you for the specific order giving rise to the claim.
This limitation applies regardless of the legal theory (contract, tort, strict liability, or otherwise) and whether or not we were advised of the possibility of such damages.
21. Indemnification
You agree to indemnify, defend, and hold harmless Fooddepaux, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your use of the Site or Products.
- Your violation of these Terms.
- Your violation of any applicable law or third-party rights.
- Any content you submit through the Site.
- Any fraudulent or false claims you make.
22. Force Majeure
We are not responsible for delay or failure to perform our obligations where caused by events beyond our reasonable control, including but not limited to:
- Natural disasters, epidemics, or pandemics.
- War, civil unrest, terrorism, or government actions.
- Disruptions to transport, supply chains, or logistics networks.
- Severe weather events.
- Power failures or internet outages.
- Labour disputes or strikes.
In such events, our obligations will be suspended for the duration of the force majeure event. If the event continues for more than 30 consecutive days, either party may terminate the affected order.
23. Governing Law & Disputes
These Terms are governed by and construed in accordance with the federal laws of the United Arab Emirates.
If a dispute arises, we encourage you to contact us first so we can try to resolve it informally. Disputes that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the competent courts of Dubai, UAE.
Nothing in this clause prevents either party from seeking urgent or interim relief from any court of competent jurisdiction.
24. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
25. No Waiver
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by Fooddepaux.
26. Entire Agreement
These Terms, together with our Privacy Policy, Shipping & Delivery Policy, and Returns, Refunds & Exchanges Policy, constitute the entire agreement between you and Fooddepaux regarding your use of the Site and supersede any prior agreements or understandings.
27. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
